Debates regarding clinical ethicists’ scope of practice are not novel and will continue to evolve. Rapid changes in healthcare delivery, outcomes, and expectations have necessitated flexibility in clinical ethicists’ roles whereby hospital-based clinical ethicists are expected to be woven into the institutional fabric in a way that did not exist in more traditional relationships. In this article we discuss three emerging roles: the ethicist embedded in the interdisciplinary team, the ethicist with an expanded educational mandate, and the ethicist as a (...) therapeutic presence in the patient care space. Such expanded capacities offer more robust, positive contributions to institutional culture, stakeholders’ relationships, and patient-centered care. (shrink)

Donation after cardiac death (DCD) traditionally occurs in two patient populations: (1) those who do not meet neurological death criteria but who have suffered severe neurological damage, and (2) those who are fully alert and awake but are dependent on machines. This case highlights the unique dilemma when a patient falls between these two populations—conscious and cognitively intact, but completely paralyzed except for limited eye movement, afflicted by what the medical community refers to as locked-in syndrome. Prompted by the treatment (...) team’s discomfort, an ethics consultant examined whether the team was obligated to discuss a decision to donate with the patient, who was a registered organ donor. This article shows how, in determining whether or not to talk to the patient or family during end-of-life decision making, the weight assigned to the various ethical concerns in the case— the patient’s condition, the decision to be made, and the family’s agreement or disagreement regarding the patient’s wishes—can “swing the pendulum” of ethical analysis in different ways. The comfort of the patient must be accorded the highest priority, as well as the needs of the patient’s family. This case study highlights the nuanced contextual factors necessary to guide a treatment team’s approach to DCD for a patient with uncertain decision-making capacity. (shrink)

Hoerl & McCormack's dual systems framework provides a new avenue toward the scientific investigation of temporal cognition. However, some shortcomings of the model should be considered. These issues include their reliance on a somewhat vague consideration of “systems” rather than specific computational processes. Moreover, the model does not consider the subjective nature of temporal experience or the role of consciousness in temporal cognition.

Decisions related to births in the “gray zone” of periviability are particularly challenging. Despite published management guidelines, clinicians and families struggle to negotiate care management plans. Stakeholders must reconcile conflicting values in the context of evolving circumstances with a high degree of uncertainty within a short time period. Even skilled clinicians may struggle to guide the patient in making value–laden decisions without imposing their own values. Exploring the experiences of one pregnant woman and her caregivers, this case study highlights how (...) bias may undermine caregivers’ ability to meet their obligation to enhance patient autonomy and the moral distress they may experience when a patient’s values do not align with their own. Management strategies to mitigate the potential impact of bias and related moral distress are identified. The authors then describe one management strategy used in this case, facilitated ethics consultation, which is focused on thoughtful consideration of the patient’s perspective. (shrink)

Prisoners are legally categorized as a vulnerable group for the purposes of medical research, but their vulnerability is not limited to the research context. Prisoner-patients may experience lower standards of care, fewer options for treatment, violations of privacy, and the use of inappropriate surrogates as a result of their status. This case study highlights some of the ways in which a prisoner-patient’s vulnerable status impacted the care he received. The article argues the following: (1) Prisoner-patients are entitled to the same (...) quality of care as all other patients, and healthcare providers should be vigilant to ensure that the stigma of incarceration does not influence care decisions. (2) Options for treatment should reflect what is most medically appropriate in the hospital or other healthcare setting, even when not all treatments would be available in the correctional setting. (3) The presence of guards at the bedside requires that additional measures be taken to protect the privacy and confidentiality of prisoner-patients. (4) When endof-life decisions must be made for an incapacitated patient, prison physicians are not well placed to act as surrogate decision makers, which heightens the obligations of the healthcare professionals in the hospital to ensure an ethically supportable process and outcome. Therefore, healthcare professionals should provide extra protection for those prisoner-patients who do not have decision-making capacity, by utilizing a robust process for decision making such as those used for incapacitated patients without surrogates, rather than relying solely on prison physicians as surrogates. Despite an abundance of academic conferences, clinical ethicists lacked a forum to share innovative practices with peers and to generate solutions to common challenges. Organizers of the first Clinical Ethics Un-Conference developed a working event centered on active participation and problem solving through peer learning, with the goal of improving realworld practice. Registrants included 95 individuals from 64 institutions. Attendees were surveyed immediately after the Un-Conference, and again eight months later. After eight months, 85 percent (n = 33/39) of the (...) survey respondents reported that they found the event “highly impactful” or “some-what impactful” to their clinical practice, and 23 attendees reported that they had implemented ideas or projects inspired by the event. Three sets of best practice guidelines and four white papers were published from the event. As the field of clinical ethics continues to advance and evolve, this working event format offers an innovative, disruptive alternative to a traditional conference format and may serve as a model for future efforts aimed at improving real-world clinical ethics practice. Drawing on pedagogical tools utilized in clinical scenario simulation and emergency preparedness training, the authors describe an innovative method for teaching clinical ethics consultation skills, which they call a “tabletop” exercise. Implemented at the end of a clinical ethics intensive course, the tabletop enables learners to implement the knowledge and practice the skills they gained during the course. The authors highlight the pedagogical tools on which the tabletop exercise draws, describe the tabletop exercise itself, offer how to best operationalize such (...) an exercise, reflect on the method’s strengths and weaknesses, and provide insights for others who may want to implement their own tabletop for ethics consultation education. When patients are not able to speak for themselves, surrogate decision makers are asked to guide treatment decisions and formulate a plan of care in accordance with what the patients would have wanted. This necessitates an exploration into the patients’ views about life and how it should be lived, how the patients constructed their identity or life story, and their attitudes towards sickness and suffering. When an individual appoints a surrogate, such as a healthcare power of attorney, a common presumption (...) is that this designation evinces merit. This obscures the possibility of multiple other considerations that influence individual choice. This article presents a clinical case in which the claim to know someone best created a controversy that brought treatment decisions to a standstill. Further, it illuminates how the question, “Given the current medical condition, what would this person want?” risks presuming that a singular, unambiguous preference exists and that one person can provide the answer. Clinical ethicists can play a vital role in situations when there is a dispute among a designated surrogate and family members over a patient’s preference. By embracing the complexity of the desire to synthesize seemingly irreconcilable perspectives about identity, uncovering the reasons that underlie disagreement, and guiding inquiry in such a way that allows stakeholders to move beyond the conflict, clinical ethicists can facilitate decision making that honors the patient and may mitigate moral distress. While valuable work has been done addressing clinical ethics within established healthcare systems, we anticipate that the projected growth in acquisitions of community hospitals and facilities by large tertiary hospitals will impact the field of clinical ethics and the day-to-day responsibilities of clinical ethicists in ways that have yet to be explored. Toward the goal of providing clinical ethicists guidance on a range of issues that they may encounter in the systematization process, we discuss key considerations and potential challenges in (...) implementing system-wide ethics consultation services. Specifically, we identify four models for organizing, developing, and enhancing ethics consultation activities within a system created through acquisitions: train-the-trainer, local capacity-building, circuit-riding, and consolidated accountability. We note each model’s benefits and challenges. To our knowledge, this is the first paper to consider the broader landscape of issues affected by consolidation. We anticipate that clinical ethicists, volunteer consultants, and hospital administrators will benefit from our recommendations. (shrink)

Checklists have been used to improve quality in many industries, including healthcare. The use of checklists, however, has not been extensively evaluated in clinical ethics consultation. This article seeks to fill this gap by exploring the efficacy of using a checklist in ethics consultation, as tested by an empirical investigation of the use of the checklist at a large academic medical system (Cleveland Clinic). The specific aims of this project are as follows: (1) to improve the quality of ethics consultations (...) by providing reminders to ethics consultants about process steps that are important for most patient-centered ethics consultations, (2) to create consistency in the ethics consultation process across the medical system, and (3) to establish an effective educational tool for trainers and trainees in clinical ethics consultation. The checklist was developed after a thorough literature review and an iterative process of revising and testing by a group of experienced ethics consultants. To pilot test the checklist, it was distributed to 46 ethics consultants. After a six-month pilot period in which ethics professionals used the checklist during their clinical activities, a survey was distributed to all of those who used the checklist. The 10-item survey examined consultants’ perceptions regarding the three aims listed above. Of the 25 survey respondents, 11 self-reported as experts in ethics consultation, nine perceived themselves to have mid-level expertise, and five self-reported as novices. The majority (68 percent) of all respondents, regardless of expertise, believed that the checklist could be a “helpful” or “very helpful” tool in the consultation process generally. Novices were more likely than experts to believe that the checklist would be useful in conducting consultations. The limitations of this study include: reduced generalizability given that this project was conducted at one medical system, utilized a small sample size, and used self-reported quality outcome measures. Despite these limitations, to the authors’ knowledge this is the first investigatation of the use of a checklist systematically to improve quality in ethics consultation. Importantly, our findings shed light on ways this checklist can be used to improve ethics consultation, including its use as an educational tool. Effective documentation is considered a core competency for clinical ethics consultation. Ethics consultants within the Cleveland Clinic in Cleveland, Ohio, observed variation in the formatting of ethics chart notes across consultants and realized that this formatting was based on their own views of effectiveness. To minimize variation and optimize the readability and understandability of ethics chart notes for end users, a team undertook a quality improvement project to assess the formatting preferences of healthcare professionals who rely on ethics consultation notes. (...) The team developed three sample templates and conducted interviews with stakeholders to understand their preferences. A single standardized template was developed based on the preferences that emerged, which all consultants on the ethics consultation service then utilized. In the first five months of implementation, the percentage of end user respondents marking the highest Likert scale option on a post-consultation survey regarding whether the ethics consultation service provided helpful documentation increased from 60 percent to 72 percent compared to the same five-month period in the year prior. The book presenting such an argument and thesis could in some ways be both more elegant and more helpful than this collection; it could spend fewer of its pages in arguing against other interpreters over minor differences (the standard journal-article format for our time), more of its pages awakening the texts, eliciting their message, and presenting it in a form useful for guiding life. Perhaps Cooper will write such a book soon.But the present volume will certainly be of interest to scholars and students, who will find in it much to enjoy and ponder. Generally what is striking about Cooper's interpretations is their freshness. He is at his best when dislodging some stale orthodoxy. The essay on Xenophon's Socrates is a case in point. The portrait of Socrates which emerges in Xenophon's Memorabilia is usually taken to be far less accurate than that presented in Plato's earlier dialogues. The Memorabilia seldom appear on the required reading lists of Greek philosophy courses, nor does Xenophon's version of Socrates' approach to moral questions receive even a fraction of the scholarly attention devoted to Plato's early work. Cooper convincingly shows this neglect to rest on a prejudice. The Socrates of Xenophon's portrait addresses a different kind of audience than that of Plato; the difference in the style of questioning and in the topics discussed reflects the historical Socrates' sensitivity to his partners in conversation. He addresses them where they live (so to speak), and this makes him "all the more remarkable a person" (14).Two other strengths run throughout the essays here collected. No matter how intense the exegetical quibble may have become on any given page, Cooper is able to make a sudden soaring flight upward and provide a synoptic view of the broader philosophical terrain, both for any given philosopher and for that philosopher's contemporaries, predecessors, and successors. Our planet contains 194 independent states and much more nations. They share membership of the United Nations and in consequence they subscribed the Universal Declaration of Rights. These are rooted in the modern universal conception of states and human rights formulated by philosophers of the Enlighten Age like Locke, Kant., Montesquieu, Voltaire and Rousseau. Concepts like democracy are mirrored to the organization of the political life as it was developed in North America and Europe at the end of the 18th (...) and the 19th century. Universality was deeply rooted in the Western intellectual, moral and religious tradition of that part of the world. Even globalization of the economic and social life is governed by the same Western standards and worldwide consumed basic goods like prime matter,. food and energy is expressed in terms of Western currency like dollar, pound sterling or euro. Despite this economic globalization there were two contradictory political evolution to discern: At the one hand more than 70 new states where created and on the other hand 28 European states started to integrate to a political European Union. The latter trend was based on a deep economic integration and since the creation of the euro also a financial integration. Basic idea was the creation of a free economic market as bases for a political unified Europe. Euro criticism is not only identified with conservatism, nationalism, narrow mind and even racism, euro criticism is deprived from any intellectual significance. However other trends put some shadow on the European project. First the Soviet experience around Marxism, Leninism and Stalinism unified more different nations than the European Union but ended in a complete political and economic chaos. Secondly the financial euro crisis involves only the tacit undermining of the national political independence of the member states, but does not make room for a deep analysis what the fundamentals are of this crisis such as lack of confidence of the citizen in the created unified political and financial market and its main instruments like banks that we consider as the fundamental boundary conditions of the worldwide globalization of goods, power and all aspects of human life. Furthermore we claim that this market in al its aspects is the worst answer to the inconvenient yet unavoidable truth that Western way of life of consumption includes a ecological footprint that exceeds since many years the sustainability of our planet. -/- . Schleiermacher's Copernican revolution in theology is effected through his presentation of the Christian mythos in terms of a phenomenological anthropology of self-consciousness. Moreover, as Niebuhr shows in this apt study of some features of Schleiermacher's theological thinking, the principles which determine the shape of that revolution can be deduced neither from a biblical dogmatics allegedly purified of philosophical presuppositions nor from a philosophy uninformed by theological experience. In the first part of the book, Niebuhr discusses Schleiermacher's little-known work The Christmas (...) Eve: A Dialogue, affording us a picture of the author's starting-point in the experience of a salvation or potentiated self-consciousness which is historically and socially mediated. The subsequent analysis of the lectures on hermeneutics and ethics discloses the object of Schleiermacher's inquiry to be not the supernatural being that posits the cosmos, but the creative Logos indwelling the individual and all men by means of the common, organic media of human existence in which the self both comes to be and comes to create history and culture. Finally, The Christian Faith is reviewed by Niebuhr in terms of the expression it gives to the mature Schleiermacher's theology and christology. The primordial consciousness of being-in-relation reveals the historical, societal, worldly context of the self and the various polarities of the self's existence such that religion emerges as a phenomenon coterminous with man's affective response to the relationships in which the whole of human nature is bound, and theology, the "daughter of religion," becomes the methodology by which the articulation of an affective determination of self-consciousness is achieved. The rigorously pursued explicitation [[sic]] of the forms and determinations of self-consciousness is interpreted by Niebuhr with a penetration and a sympathy at once acute and comprehensive. By giving us a series of insights into Schleiermacher's "thinking in motion," Niebuhr has contributed a cogent testimony to the nineteenth-century theologian's central importance in the fields of hermeneutical theory, philosophical ethics, philosophy of religion and culture, and theology. One would have welcomed a more critical appraisal of Schleiermacher's view of the formal and material compatibility of philosophy and theology, understanding and feeling, inasmuch as the scope of theological inquiry appears to be limited by the boundaries of reason set forth in the ethics, and philosophical anthropology is apparently reduced to a rather sophisticated phenomenology of religious experience. Taking Max Weber's conception of the modern capitalist world system as a classical precedent, and with reference to a series of analytical schemas on capital formation, this essay takes three recent books as a starting point for examining the revival of critical theoretical attention to 'the new capitalism'. The Social Structures of the Economy by Pierre Bourdieu focuses on the erosion of the separation between business and household economies by providing a case study of the construction boom in single-family dwellings (...) which replaced the public housing movement in 1980s France. Also concentrating on recent French history, Luc Boltanski and Eve Chiapello, in their monumental book The New Spirit of Capitalism, argue that the post-industrial restructuring of 'formally free' labour was provoked by countercultural protest in the 1960s and further justified by managerial discourses advocating postmodern 'flexibilization' in the 1990s. Finally, Nigel Thrift's Knowing Capitalism enumerates recent examples demonstrating how the 'rational' accounting of economic capital is increasingly expanded and intensified by commodified cultural circuits which facilitate flows of information between business schools, management consultants and entrepreneurial gurus and in a variety of everyday spaces and ordinary practices. While each of these works convincingly projects the resurrection of 'the spirit of capitalism' on local and global scales, they have less to say about the underlying political dynamics or emerging alternatives to this process. Are living organisms--as Descartes argued--just machines? Or is the nature of life such that it can never be fully explained by mechanistic models? In this thought-provoking and controversial book, eminent geophysicist Walter M. Elsasser argues that the behavior of living organisms cannot be reduced to physico-chemical causality. Suggesting that molecular biology today is at the same point as Newtonian physics on the eve of the quantum revolution, Elsasser lays the foundation for a theoretical biology that points the way toward a (...) natural philosophy of organic life. Explicitly repudiating "vitalism" (the notion that the laws of nature need to be modified when applied to living organisms), Elsasser argues instead that the structural complexity of even a single living cell is "transcomputational"--that is, beyond the power of any imaginable system to compute. Beginning from this insight, Elsasser leads the reader through a step-by-step process that ultimately arrives at the conclusion that living and non-living matter are separated by "a no-man's land of irrationality." Trained in Germany as a physicist, Elsasser first pondered the implications of quantum mechanics for biology as early as 1951. The more closely he studied the inherent complexity of life, the more skeptical he became of the reductionist view of organisms as tiny machines. "An organism," he concluded, "is a source of causal chains which cannot be traced beyond a terminal point because they are lost in the unfathomable complexity of the organism." Like the physicist who works within the bounds of an unfathomable universe, Elsasser argues, the biologist must seek answers within a system that is no less unfathomable. (shrink)

It was in December 1868, a little less than fifteen years before his death, that T. H. Green entered into correspondence with the young Henry Scott Holland and R. L. Nettleship on the occasion of the latter's visit to the young Gerard Manley Hopkins, then on the threshold of entering the novitiate of the Society of Jesus. Part of this correspondence is preserved in Stephen Paget's memoir of Scott Holland, and no student of the interpretation of Christianity in the writings (...) and teachings of the British Idealists should neglect either this exchange of letters, or indeed the latter correspondence with Scott Holland in which the young Anglican, on the eve of his own ordination, sought to defend his commitment to his mentor. In Epistemology of the Closet, Eve Kosofsky Sedgwick explores the connection between the binaries of heterosexuality/homosexuality and the utopian/apocalyptic. In doing so, she exposes the commonplace of a “fantasy trajectory toward a life after the homosexual.”1 In this narrative model, once the queer has completed its function of purging the symbolic of its sins, the character is eliminated from the text as part of the emergence of a postnarrative hetero-normative utopia. In a similar vein, Lee Edelman’s “Against Survival: Queerness in (...) a Time That’s Out of Joint,” an essay on the quintessential revenge tragedy, Hamlet, notes that the revenger’s death ensures a return of society’s idealized vision of the future.2... Wit explores modes of reading representations of death and dying, both through the play’s sustained engagement with Donne’s Holy Sonnets and through Vivian’s self-reflexive approach to her illness and death. I argue that the play dramatizes reparative readings, a term coined by Eve Kosofsky Sedgwick to describe an alternative to the paranoid reading practices that have come to dominate literary criticism. By analyzing the play’s reparative readings of death and dying, I show how Wit provides lessons about knowledge-making and reading (...) practices in the field of health humanities. (shrink)

ABSTRACT While claiming to be a much-needed corrective to the dual disappointments of structuralism and post-structuralism, one is starting to get the sense that affect may have simply inverted, rather than resolved, the binary of form/feeling. Yet emerging within and against the affective turn is a re-turn to structure as the condition of possibility for affectivity. From this re-turn, which I'll term affective formalism, is culled the transdisciplinary exemplars reviewed here: Ruth Leys's The Ascent of Affect, Gary Genosko's Critical Semiotics, (...) Eugenie Brinkema's The Forms of the Affects, with a nod to Eve Sedgwick's Touching Feeling. Far from caging affect, these new books suggest a return to form, once again, with feeling. (shrink)

“Congealing” is a word that evokes senses of unpleasantness where perhaps something inviting had once been. It also implies that things are becoming less fluid and more rigid. As we began organizing ETHICOMP 2018, we wanted a theme that reflected the impact of technologies on human cultures, practices and lives. Our initial draft of the theme was “Creating, Changing, and Congealing Ways of Life with Technologies.” And while we were eventually persuaded to use a more congenial way of putting the (...) idea (it became “Creating, Changing, and Coalescing Ways of Life with Technologies”), in some ways, it remains true for us that “congealing,” and its connotations of something less pleasant, gets at the original idea. As we incorporate technologies into our practices, much attention is paid to how they change our ways of doing things. But technologies can also help ways of life set-up and harden like yesterday’s leftovers – not appealing, yet difficult to budge and sometimes quite unhealthy. Once a particular process is built around a piece of technology, it can become entrenched and increasingly difficult to change. For a historical example, consider how difficult it was to adapt records and software on the eve of the 21st century in response to the so-called “Y2K” problem. In early software development, efficient use of memory was an important design consideration. It had become a standard practice to use a 2-digit field for the year, which would roll to from “99” to “00” in the year 2000, causing problems for datedependent functions. Technologies can also reflect and reinforce existing cultural tendencies. For a recent example, consider the human resources software created by Amazon that used its existing hiring data to train a machine-learning system to rate applicants. The resulting system turned out to be biased against women applicants, downranking resumes that included the word “woman” or “women’s.” Amazon ended up scrapping the project altogether. Because of these kinds of effects, we wanted to encourage people to think beyond well-worn paradigms like “technologies are disruptive” to consider other kinds of effects they can have. As it happened, the imagery of “congealing” proved distasteful enough that the steering committee opted for a more neutral term. But even with the less-dramatic wording the conference ended up attracting a rich and diverse range of papers that examined technological issues from a variety of angles, exactly as we had hoped. The stock market’s reaction to information disclosure of environmental violation events (EVEs) is investigated multi-dimensionally for Chinese listed companies, including variables such as pollution types, information disclosure sources, information disclosure levels, modernization levels of the region where the company locates, ultimate ownership of the company, and ownership held by the largest shareholder. Using the method of event study, daily abnormal return (AR) and accumulative abnormal return (CAR) are calculated under different event window for examining the extent to which the stock (...) market responds to the EVEs. Furthermore, statistical significance of the difference in stock market reaction is compared between event firms with different characteristics. The relationship between CAR and its impact factors is examined by multivariate analysis. The findings reveal that the average reduction in market value is estimated to be much lower than the estimated changes in market value for similar events in other countries, demonstrating that the negative environmental events of Chinese listed companies currently have weak impact on the stock market. The Branch of Social Sciences of the Russian Academy of Sciences (RAS), the Institute of Sociology of the Federal Center for Theoretical and Applied Sociology of the RAS, the RAS Institute of Philosophy, and the RAS Institute of Psychology are arranging “Individualization and Collectivism in Contemporary Russian Society” scientific conference, to be held in Moscow, April 2024. The event marks the 300th anniversary of the Russian Academy of Sciences and the 95th birth anniversary of the Russian philosopher and social theorist (...) A.S. Akhiezer. Its primary objective is to foster the development of criteria for analyzing intersubjective relations within the act of social development. The conference’s focus on the investigation of social development is grounded in the dominants of contemporary philosophical-sociological non-classics and proposes several topics for discussion. These include the transition from the absolutization of Kant’s categorical imperative, which mandates the consideration of humans solely as the ultimate end in the system of intersubjective communication and the knowledge process, to an alternative consideration of humans as means of self-improvement and a crucial resource for social development (V.S. Bibler). It encompasses the rejection of absolutizing the function of contrasting faith and knowledge, the Self and the Other, the “own” and the “foreign,” scientific and everyday consciousness (V.A. Lectorsky, I.T. Kasavin, V.N. Porus). The interpretation of the meaning of personality shifts from concepts like cogito ergo sum, “pure Self,” “Self,” “Ego,” “Super-,” to the “ability of the Self to respond to the call of the Other,” thereby forming the smallest cell of the socio-individual as a synthesis of the social and the individual (M.M. Bakhtin, V.A. Lectorsky, R.S. Grinberg). Overcoming the established inequality of economic systems is addressed through the socio-individualism of small and medium-sized enterprises (A.S. Akhiezer, R.S. Grinberg). The conference also anticipates discussions on the following topics: How do the transfer and exchange of accumulated global knowledge from the individual to the other, and vice versa, contribute to the formation of small creative groups, serving as a communicative platform for nurturing socially oriented individuals – agents of social development? Moreover, how can dialogue be effectively constructed among participants of partnership relations who operate on differing premises (J.-P. Sartre)? The discussion is aimed at contemplating the contradictory, oxymoronic, yet dialogue and synthesis-oriented concepts of “individualization of the social,” “socially oriented individual,” and “socio-individualism.”. Although Dirār b. ʿAmr is the most important mutakallim of the second century, he is unfortunately one of the unjustified names in the history of kalām. Dirâr is a mutakallim whose name is rarely mentioned in theological publications published in both Turkish and foreign languages until recently, and his importance and position are still not noticed. As a matter of fact, Josef van Ess and W. Montgomery Watt, who are famous orientalists, discovered this tragic fact and tried to make up (...) for this deficiency to some extent with their studies. Dirâr wrote a refutation of Aristotle's theory of substance and accident, opened a new way with his understanding of existence based on accidents and led Ash'ari with the theory of kasb and Ebu'l-Huzayl al-‘Allaf with his kalām accumulation. Undoubtedly, one of the things that makes Dirār important is that he had views that went beyond his time and caused him to contradict his contemporaries as early as the second century in terms of the history of Islamic thought. Considering the list of works that have not survived, except for one, in such a period when the mainstream sects were not yet formed and they were on the eve of their formation, Dirār was generally in a critical dialogue with the Islamic and non-Islamic movements he encountered and knew. For this reason, it is almost impossible to place him in any religious sect mentioned in his period. Because he often preferred to follow his own ideas rather than the opinions of others on many issues. Naturally, this makes it difficult to place Dirār in a certain school and frees him from all kinds of bonds. Yes, in the sources we come across many allegations, accusations and slanders that Dirār is a Cahmi/Jabri, he is a Mu‘tazili, he is an innovator with malignant ideas, he is an infidel to put a bounty on his head. Understanding the reasons for these depends on getting to know Dirār, understanding his ideas, and determining his position. If we say in the context of our study, the position of Dirār is actually a state of non-position, and we think that the concept that best expresses this situation in a new interpretation is "nawābit". In the light of our analysis, we see that, with the exception of a name, nawābit is used as a concept with a negative content and connotation in both theology and philosophy. The exceptional person is the famous philosopher Ibn Bājja (Avempace) from Andalusia, the contemporary of Ibn Rushd (Averroes). While Mu‘tazili mutakallims use nawābit to humiliate groups such as Ahl-i hadith and Hashviyye, which adopt the narration-oriented line that puts reason and acumen to the second place, Al-Fārābī also uses the fault types and the sick characters in his virtuous city that he has constructed to describe. Ibn Bājja, on the other hand, considers the people called nawābit within his project to be equivalent to the "mutawahhid" (alone human) whose "precaution" he aims; this usage which corresponds with the context of the concept in the study. What we need is, first, a detailed specification of the range of goods towards which reason directs us, then, an explanation of how reference to these goods is explicit or implicit in those precepts directive of action upon which prudence has to he able to draw (if it is to function in such (...) a way as to break with the otherwise vicious circle), and, finally, an explanation of how in the concrete circumstances of social life the precepts of reason can become effective. The absence of a systematic treatment of goods, which I noticed earlier, therefore turns out to he an important omission from Cessario's account, since without it a crucial part of his argument remains incomplete. What makes this omission all the more disappointing is the excellence of Cessario's subsequent discussion of the relationship of the theological virtues to the intellectual and moral virtues and of how the habitus of nature are enriched and strengthened by the habitus of grace. Teachers of moral theology could reflect on this discussion with great benefit to their students. It is a mark of how very good a hook Cessario has written that it arouses enormous impatience for a sequel which will not only carry the argument further hut also fill out what is missing in the argument so far. When completed, the Opera Omnia will contain not only vast writings on analogy and the nature of philosophy hut also the single most thorough, and arguably most profound, exposition of the Secunda pars of St. Thomas Aquinas's Summa theologiae ever written. The present installment covers qq. 71-85 of the Prima secundae. BOOK REVIEWS 345 Although the Spanish province of the Dominican Order has taken over the publication and distribution of Ramirez's Opera Omnia from the Consejo Superior de lnvestigaciones Cientificas, who began the series and oversaw the publication and distribution of all previous volumes, the new volumes' physical constitution is identical to that of the earlier volumes, since the actual printing is done at the same house. The volumes read easily, not only because they are in octavo form, hut also because the publishers have done the printing on an off.white paper, with leisurely spacing of the 11 point type. The second volume contains four indices: an index of names, biblical references, references to Thomas's writings, and a schematized index of the contents of both volumes. In a project of this magnitude one is prepared to find printing mistakes, and there are occasional typographical errors and formatting errors such as mis-italicization. In one place there is an omission of an entire line. (In vol. 2, p. 537, no. 373, the citation from Innocent III, after the words ' visionis Dei,' should be completed with the following: " (= damni tantum), actualis vero poena peccati est gehennae perpetuae cruciatus.") But these are minor imperfections, and the editor Fr. Rodriguez once again deserves our thanks for making such learning tools available to us in so useful a format. Rodriguez has informed me that the next volume to appear will be De gratia in 1991, despite the fact that a treatment De lege would of course be in keeping with the order of the Prima secundae. This substantial volume is dedicated to furthering an “ecological understanding of the pre‐Columbian New World by creating evaluations of prehuman vegetation and then offering discussions as to how humans became involved in local ecosystems” . These topics are timely, since the last decade has seen a flowering of debate and reconsideration of previously held views of pre‐Columbian human environmental impacts in the Americas. The book contributes to those discussions by assembling examples of the current state of knowledge of pre‐Columbian ecologies (...) and of their human uses and modifications for a number of selected areas in the Americas.This somewhat eclectic book, edited by David Lentz, presents empirical evidence of human use of and change to local and regional ecologies in ten chapters. Additional chapters are devoted to useful inventories of pre‐Columbian vegetation patterns in North and Middle America and in the lowland tropics and tropical Andes, although the vegetation pattern theme is not uniformly addressed in the case studies. One chapter is devoted to climate change in the northern neotropics since the last Ice Age, yet this discussion applies to only a small part of the hemisphere discussed in the case studies.The case study chapters mostly address agricultural modifications. These include entries on pre‐Columbian anthropocentric food webs that are both general and specific to Mesoamerica; late precontact agricultural landscapes in the Valley of Mexico; the ancient water management systems for agriculture in central and southern Mexico and Venezuela; environmental impacts of ancient Maya deforestation and agricultural intensification in lowland areas of northern Guatemala, Belize, and the southern Yucatán peninsula; pre‐Columbian silviculture and management of neotropical forests; pre‐Columbian farming systems of the Mississippi River Valley; environmental impacts of ancient Hohokam irrigation and agriculture in the Sonoran desert; the built landscape in the Lake Titicaca basin; agricultural systems, modified landscapes, and cultural values in the pre‐Inca and Inca‐era central Andes and Peruvian coast; and impacts of pre‐Columbian agriculture and other land uses in riverine areas near the mouth of the Amazon River.Given its somewhat uneven case study approach and despite broader chapters on climate change and prehuman vegetation patterns, this book is not a systematic approach to or a comprehensive statement on pre‐Columbian landscape transformation. It does not address large regions of the Americas or all time frames; nor does it address all forms of modification . Nevertheless, this book's virtues outweigh its shortcomings, and themes emerging from these studies address major ongoing debates over the nature and scale of pre‐Columbian environmental impacts. The first is that large regions of the pre‐Columbian Americas were transformed in some way before European contact—thus these regions, encompassing much of the most populated New World, cannot be thought of as “pristine.” The second is that the nature of changes wrought to these regions are varied. Some were profound and easily seen, others subtle and visible only to expert eyes; some represented long‐term, relatively “sustainable” modifications, while others may have triggered degradation. Lastly, these transformations occurred over a very long time frame and regions that were heavily modified at some time may not have appeared so on the eve of European contact. (shrink)

Several variants of Lewis's Best System Account of Lawhood have been proposed that avoid its commitment to perfectly natural properties. There has been little discussion of the relative merits of these proposals, and little discussion of how one might extend this strategy to provide natural property-free variants of Lewis's other accounts, such as his accounts of duplication, intrinsicality, causation, counterfactuals, and reference. We undertake these projects in this paper. We begin by providing a framework for classifying and assessing the variants (...) of the Best System Account. We then evaluate these proposals, and identify the most promising candidates. We go on to develop a proposal for systematically modifying Lewis's other accounts so that they, too, avoid commitment to perfectly natural properties. We conclude by briefly considering a different route one might take to developing natural property-free versions of Lewis's other accounts, drawing on recent work by Williams. (shrink)

Since the publication of David Lewis's ''New Work for a Theory of Universals,'' the distinction between properties that are fundamental – or perfectly natural – and those that are not has become a staple of mainstream metaphysics. Plausible candidates for perfect naturalness include the quantitative properties posited by fundamental physics. This paper argues for two claims: (1) the most satisfying account of quantitative properties employs higher-order relations, and (2) these relations must be perfectly natural, for otherwise the perfectly natural properties (...) cannot play the roles in metaphysical theorizing as envisaged by Lewis. Spinoza, according to common opinion, could only have written lamentable platitudes on sexual love, narrowly inspired by the prejudices of his time and without serious philosophical foundation: that for which, in the past, he has been congratulated,1 he is now reproached; or, at best, excused. He would even have, some believe to be able to add, increased the pervading puritanism: sexuality, as such, would give rise in him to a deep repulsion and women would horrify him. The second of these (...) two assertions, if one sticks to the manifest content of the texts, actually rests on nothing; if one calls upon their latent content, it would require, to be established with a minimum of rigor, a study of which we will not dispute the theoretical possibility, but which, in fact, has not yet been undertaken. The first, on the other hand, has all the appearance of the obvious: that men love women for their beauty and do not support their attachment to someone else,2 that they desire them more the more admirers they have,3 that the jealousy of the male is exacerbated by the representation of the pudenda and of the excrementa of his rival,4 that sensual attachment is unstable and conflictual,5 that it often turns to obsession,6 that Adam loved Eve because of their similarity of nature,7 that he who remains insensitive to the generosity of a courtesan does not offend by ingratitude,8 that only free men and free women can marry one another and only if they want children,9 well, it seems, that isn’t anything sensational; now these eight passages, if the two definitions of the libido are added to them,10 are the only, if I’m not mistaken, that Spinoza expressly devoted to the question!
